ES-A46130274 and head office in Concordia Avenue 2 of 46960 Aldaia (Valencia) Spain, hereinafter JOSEBLAY, registered in the Mercantile Registry of Valencia, Volume 2320 General Section, Folio 179 Sheet V-3427. The seller informs you of the conditions for the on-line sale of its products through the website: www.joseblay.com with telephone 961 513 097 and email info@joseblay.com

The buyer must read and confirm the conditions stipulated in this document before making any purchase.


1. EMAIL COMMUNICATION

Our business hours are Monday to Friday from 09:00 - 15:00. During these business hours we will respond to your email within 24 to 48 hours.

If you contact us during the weekend or holidays, please know that we will start answering all requests the next business day and we will work efficiently to answer as soon as possible.


2. ORDER PROCESSING

To process your order immediately you must make a deposit in one of our entities indicated in the “Payment Methods” section. On the other hand, if you make a transfer from another bank, or through the Internet, it will not be effective until 48 working hours of its realization, and therefore, the processing of your order will not be processed until receipt of full payment.

Order processing hours are Monday through Friday from 08:00 - 15:00. Any payment received outside this time period will be processed on the next business day.

Furthermore, orders will not be processed during national, local holidays, or vacation periods of JOSEBLAY staff.


2.1 Purchase without personal account

Our website allows the purchase without a personal account. In this mode of purchase, you will be asked only the essential data to process your order. Once completed you will have the option to create a personal account should you want it.


3. DELIVERY OF THE ORDER


3.1 Dispatch time

The average dispatch time for in-stock items is 1 to 5 business days after full payment is received.


3.2 Shipping

The purchased products will be delivered to the person/company and address indicated in the order.

By default, orders will be sent to the address indicated by the customer when registering in our online store, and invoices will be sent to the email address provided by the customer.

A delay in the estimated dispatch date will not imply neither cancellation of the order nor any compensation.

An order is considered delivered when the carrier delivers the package(s) to the customer and the customer signs for the delivery, or the carrier confirms delivery by other methods. It is the customer's responsibility to check the condition of the goods upon receipt and to indicate any anomalies on the delivery note to the carrier. No claims will be accepted 24 hours after receipt of the order.

If there is no one at the delivery address when the order arrives, the carrier or JOSEBLAY will contact the customer on the phone number or email provided. Additionally, the customer can contact the carrier through the options provided by the carrier. If in 48h the carrier has no response from the customer, the goods will be returned to our warehouse.

In case of return, the value of the goods will be refunded excluding the shipping cost twice (go and return) plus 20% handling and administration fee. If the customer wants to schedule a new delivery, the shipping costs will be charged again.

3.3 Transport

Orders may take 1 - 4 business days to arrive within Spain. International orders may take 5 - 10 business days and may take longer if customs in the destination country hold the shipment due to inspection. If you have any questions about your order please contact us at info@joseblay.com indicating your NAME, ORDER NUMBER AND CONTACT PHONE.

The transport of goods will be carried out by the company announced in the email you will receive after the shipment of your order.

The goods will be delivered within the schedule established by the delegation of the agency in your area and will be made from Monday to Friday.  

At the time of departure of the goods from the warehouse of JOSEBLAY, the seller declines all responsibility for it, passing directly to the carrier. In order to speed up the arrangements with the carrier, the Seller will provide the Buyer with the reference number of the shipment by e-mail.

4. PRICES

The prices published in joseblay.com are in EURO and are valid except for typographical errors. All prices are subject to VAT applicable on the day the order is placed.

The offers on products on sale in our online store will be displayed in the “offers” section or indicated in the product sheet, and if not otherwise indicated, will be valid as long as they are visible on the screen. ​


5. TAXES AND OTHER CHARGES

In accordance with the provisions of Article 68 of Law 37/1992 of 28 December 1992 on Value Added Tax, the delivery of the goods shall be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at any given time depending on the specific item in question. In orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT by application of the provisions of Article 21 of Law 37/1992, without prejudice to the application of taxes and duties under the regulations in force in each of these territories.  

Other expenses derived from the commercial transaction in countries outside the EU are not included in the cost of the purchase-sale, such as customs clearance, duties and taxes that will be applicable, in each case, to the entry of the goods in the country of destination and that will be borne exclusively by the buyer.  

Prices are subject to change by the seller without prior notice.

You expressly authorize us to issue the invoice in electronic form. However, you may at any time indicate to us your wish to receive a paper invoice, in which case we will issue and send you the invoice with the order.


6. METHOD OF PAYMENT  

The payment of the total amount of the purchase will include the transport costs (if selected during the purchase) and the applicable taxes in each case both for national sales and for the European Union.

The amount must be paid in advance by: ​

    • Paypal payment platform

    • Credit card

    • Bank deposit or bank transfer (please ask for details).


7. RETURNS AND CANCELLATIONS
7.1 Return of goods

Our policy, in compliance with current regulations, is to grant you the right to return any item purchased in our online store within 14 days from the date of receipt, except custom-made or modified items.

Before making the return, you will have to notify the customer service department by email indicating the order number and the reason for the return. The seller is obliged to return the amount of the sale upon receipt of the merchandise provided that it is in perfect condition, keeping intact the original packaging, as well as other protective elements and the original invoice.

If the reason for the return is that the returned item is defective or does not correspond exactly to the reference number requested in the order, our company will replace your order again at no cost to you.

If the reason for the return is that the order does not satisfy you we will refund you the value of the goods, excluding shipping and financial costs of the return, by bank transfer to your account number within 2 to 5 days of receipt of the return.

In case the item is not to your liking and you want to exchange it for another item, JOSEBLAY is exempt from shipping costs.


7.2 Cancellation of order

If the cancellation of the order arrives before the departure of goods the seller will refund 100% of the invoice minus the financial costs of the transaction. In the case of a cancellation after the order has been dispatched, the customer will have to return the goods at his expense, and upon receipt, the seller will reimburse 100% of the invoice minus the shipping and financial costs.


8. DATA PROTECTION POLICY

The buyer, in accordance with the provisions of current legislation on protection of personal data, is aware that your personal data are included in an automated file owned by the seller and are processed by it for the sole purpose of maintaining the commercial, economic, accounting, tax and administrative relationship of its customers, as well as to send commercial communications by sms and / or e-mail. The buyer may exercise their rights of access, rectification, cancellation and opposition of their data to JOSEBLAY, by sending a written notice to Avda. Concordia No. 2 - 46960 Aldaia (Valencia) Spain.


9. INTELLECTUAL PROPERTY RIGHTS

The customer will not obtain any intellectual property rights on the product purchased, only acquires the right to use the product.  

The industrial and intellectual property of our trademark, logo, images, text, fan designs and visible icons are the exclusive property of JOSEBLAY, its authors and suppliers.  

The interested use of any content published on joseblay.com is absolutely prohibited, since all visible elements on this website are protected by a copyright of authorship of each and every one of the constituent elements (text, images, logos, design, etc.).


10. APPLICABLE LAW AND JURISDICTION

These General Conditions shall be interpreted and governed in accordance with Spanish Law.

You hereby accept the exclusive jurisdiction of the Courts of Valencia, in the event of any dispute arising from the use, or content set out in our General Conditions.
